The measure enacts subsequent legislation to expand the authority of the California Energy Commission to become more of an enforcement entity rather than a policy and planning agency. Additionally, it imposes a tax upon refiners for operating in California and bases the level of the “penalty” on a number that does not account for operating costs or limit impacts to California generated revenues.
